This Cancellation & Refund Policy applies to bookings made through the Bachi platform.

Bachi Hospitality LLC ("Bachi," "we," "our," or "us") operates a technology marketplace connecting customers with independent service providers ("Partners") for private events and experiences.

By making a booking through Bachi, you agree to this Cancellation & Refund Policy.

We understand that plans can change. Refund eligibility depends on how far in advance of the scheduled service start time a customer cancels a confirmed booking.

Unless different cancellation terms are clearly disclosed and agreed to before payment, the following policy applies:

MORE THAN 7 DAYS BEFORE THE EVENT

If you cancel more than 7 calendar days before the scheduled service start time, you are eligible for a 100% refund of the Partner's service price, less any non-refundable Bachi service fees or other amounts that were clearly disclosed as non-refundable before payment.

3 TO 7 DAYS BEFORE THE EVENT

If you cancel between 3 and 7 calendar days before the scheduled service start time, you are eligible for a 50% refund of the Partner's service price.

The remaining 50% may be paid to the Partner, less applicable Bachi fees, to compensate the Partner for reserving the date and potentially declining other bookings.

Any non-refundable Bachi service fees that were clearly disclosed before payment will not be refunded.

LESS THAN 72 HOURS BEFORE THE EVENT

Bookings canceled less than 72 hours before the scheduled service start time are non-refundable, except where otherwise required by law or expressly approved by Bachi.

This includes same-day cancellations.

Cancellation deadlines are calculated based on the scheduled local start time of the booking.

For example, if a booking is scheduled to begin at 6:00 PM on Saturday, a cancellation submitted after 6:00 PM on the preceding Wednesday falls within the final 72-hour period.

The time Bachi receives the cancellation request through the Platform or another officially designated Bachi communication channel will determine when the cancellation occurred.

If a Partner cancels a confirmed booking and the customer did not cause the cancellation, the customer will be entitled to a 100% refund of amounts paid for the canceled Partner service.

Bachi may attempt to help the customer find a replacement Partner when reasonably possible.

The customer is not required to accept a replacement Partner.

If the customer accepts a replacement, any price difference or other material change must be disclosed to and approved by the customer before the replacement booking is confirmed.

Bachi does not guarantee that a replacement Partner will be available.

If a Partner fails to appear for a confirmed booking and does not provide the agreed services, the customer will generally be entitled to a 100% refund of amounts paid for the affected Partner service.

Bachi may investigate the circumstances before processing the refund.

Partners who fail to appear for confirmed bookings may be subject to suspension or removal from Bachi.

If a Partner arrives at the agreed location and is ready and reasonably able to perform the booked services, but the customer is unavailable, refuses access, provides an incorrect location, or otherwise prevents the Partner from performing the service, the booking may be treated as completed for purposes of payment and may be non-refundable.

Bachi may review exceptional circumstances on a case-by-case basis.

If a Partner fails to provide a material portion of the services included in a confirmed booking, the customer should notify Bachi as soon as reasonably possible.

Bachi may review relevant information, including:

• The confirmed booking details

• Communications through Bachi

• Photographs or videos voluntarily provided by the parties

• Statements from the customer and Partner

• Timing and duration of the services

• Other reasonably relevant information

Depending on the circumstances, Bachi may determine that a full refund, partial refund, credit, or no refund is appropriate, subject to applicable law.

A customer's dissatisfaction alone does not automatically entitle the customer to a refund where the Partner substantially performed the services described in the confirmed booking.

Customers and Partners should make material booking changes through Bachi whenever possible.

Changes may include:

• Date

• Start time

• Location

• Guest count

• Duration

• Services requested

• Additional services

• Pricing

Any additional charge resulting from a change must be approved by the customer before being processed.

Changing the date of a booking does not automatically create a right to a refund.

A customer may request to reschedule a booking instead of canceling.

Rescheduling is subject to Partner availability and is not guaranteed.

If the Partner agrees to the new date and time, Bachi may update the booking accordingly.

A Partner is not required to accept a rescheduling request.

Bachi may treat repeated rescheduling attempts or rescheduling intended primarily to avoid an applicable cancellation charge as a cancellation under this Policy.

Bachi recognizes that severe weather, government restrictions, emergencies, natural disasters, transportation disruptions, and other circumstances outside the reasonable control of the customer or Partner may make a booking impossible or unsafe to perform.

In these situations, Bachi may work with the customer and Partner to:

• Reschedule the booking

• Issue a Bachi credit

• Issue a partial refund

• Issue a full refund

The appropriate resolution will depend on the circumstances and applicable law.

Ordinary rain, anticipated weather, changes in personal plans, or other circumstances that do not reasonably prevent the service from taking place do not automatically qualify for an exception.

Certain Partners may purchase food, ingredients, rentals, supplies, equipment, transportation, or other items specifically for a customer's booking before the event.

If these costs were disclosed to the customer as non-refundable before payment or were specifically authorized by the customer, those documented costs may be deducted from an otherwise available refund to the extent permitted by law.

Bachi may charge a service fee in connection with a booking.

Whether a Bachi service fee is refundable will be clearly disclosed to the customer before payment.

Where a fee is disclosed as non-refundable, it will generally not be returned following a customer-initiated cancellation except where required by applicable law.

If a Partner cancels the booking and the customer does not accept a replacement, Bachi may refund applicable Bachi service fees associated with the canceled service.

Customers should contact Bachi if they believe a refund is owed or there is a problem with a booking.

Nothing in this Policy prevents a customer from exercising legitimate rights available through their payment provider or applicable law.

However, fraudulent, knowingly false, or abusive payment disputes may result in account restrictions or termination.

Approved refunds will generally be returned to the original payment method used for the booking.

After Bachi or its payment processor issues a refund, the time required for the refund to appear in the customer's account depends on the customer's financial institution or payment provider.

Bachi cannot control processing times imposed by banks, card issuers, or other financial institutions.

This Cancellation & Refund Policy applies only to payments and bookings processed through Bachi.

Bachi cannot administer refunds or payment disputes involving payments made directly between customers and Partners outside the Bachi platform.

Users should not move Bachi bookings or payments off the Platform for the purpose of avoiding applicable Bachi fees or policies.

Nothing in this Cancellation & Refund Policy limits any refund, cancellation, or consumer protection right that cannot legally be waived.

If applicable law requires a different result from this Policy, applicable law will control.

The version of this Cancellation & Refund Policy presented or made available to the customer when the booking is confirmed will generally apply to that booking, except where applicable law requires otherwise.
